Terms and Conditions, also known as Terms of Service or Terms of Use, are essentially rules that enable the extent of use deemed acceptable, rights, and responsibilities of both the service provider-a website, app, or company the users or customers. This protects both parties from any improper connotation by describing what is expected from each party. The following are key ingredients in the Terms and Conditions.
Acceptance of Terms
Acceptance of Terms informs the users that by accessing or using the service, they agree to be bound by these terms. Many include that users should not use the service if they agree with the terms and conditions.
Eligibility
Lists who may use the service, including minimum age requirements, geographic restrictions, and other factors affecting eligibility.
User Responsibilities: Lists those rules a user of the service has to follow, including but not limited to usage that is not for any unlawful purposes, not in violation of anybody’s intellectual property, and refraining from violent or offensive material.
Changes to Services
Changes to Services states that the provider reserves the right to, at any time, modify, suspend, or terminate the service or part of the service.
Ownership of Content and Use: Informs who owns the content passed through the service, meaning user-generated material or the service’s material of content, and the rights that either party may exercise in relationship to the content.
Intellectual Property
Discusses ownership of trademarks, logos, software, and other intellectual property, and terms and conditions under which access to and use them is allowed or forbidden.
LIMITATION OF LIABILITY This is a situation where liability, on the part of the provider, is limited in case there is a loss of data, damage, and other issues that may emanate from the use of the service.
